Online Terms and Conditions

Standard conditions of sale for the online purchase of goods from Tata Steel UK Limited (trading as Catnic) (“Catnic”) (the “Conditions”). Our company number is 02280000 and our registered office is at 18 Grosvenor Place, London SW1X 7HS. Our VAT number is GB238712260.

Formation of contract and order process

  1. Subject to Condition 2, these Conditions apply to all goods which are purchased via Catnic’s website (www.catnic.com). Please read these Conditions carefully because they will form the basis of a legally binding contract between you and Catnic when you place an order on our website to purchase goods from us, as described in more detail below.
  2. These Conditions apply only if you are buying goods on our website as a consumer (i.e. for purposes outside of your business, craft or profession). If you are buying goods on Catnic’s website in the course of business, our business terms and conditions apply to such purchases, which can be accessed here: https://www.tatasteeluk.com/terms-and-conditions
  3. By electronically accepting these Conditions you are confirming that you agree to and accept these Conditions, our Website Terms of Use, our https://www.tatasteeluk.com/privacy-statement, and any other terms, policies and documents referred to in these Conditions.
  4. You may place an order on our website by selecting the items which you wish to purchase (“Goods”) and adding them to your basket. Your basket will set out the details in relation to the Goods and your selected delivery option (“Order”). Please review and check your Order carefully before submitting it. You will be able to correct any errors before submitting your Order to us. Please note that you must be 16 or over to place an Order.
  5. When you place your Order at the end of the online checkout process by clicking on the ‘pay now’ button, we will acknowledge your Order by email. This acknowledgement does not mean that your Order has been accepted by Catnic.
  6. Catnic may contact you to say that we do not accept your Order, for example, if:
    • (a) the Goods are unavailable;
    • (b) we cannot authorise your payment;
    • we are not allowed to sell the Goods to you;
    • there has been a mistake on the pricing or description of the Goods;
    • (e) we cannot deliver the Goods to you due to your location being outside of mainland Great Britain; or
    • (f) you are under the age of 16.

Delivery

  1. We will use a third-party service provider to deliver your Goods. For information on delivery options and costs, please see our Delivery Policy. During the online checkout process, you will be given available delivery options to choose from.
  2. The delivery date for the Goods will be provided in your Order Confirmation (“Delivery Date”). The Delivery Date is provided as an estimate only and may change.
  3. If something happens which is outside of our control and affects the Delivery Date, we will contact you as soon as possible and you will be provided with a revised Delivery Date. As long as we do this, Catnic will not be liable for any losses, costs or other amounts caused by a delay in delivery.
  4. Delivery will take place once the Goods have been unloaded kerbside at the address specified by you when you placed your Order with us. This means that the Goods will be delivered to the nearest kerb outside of the address specified in your Order.
  5. You must do all that you reasonably can to ensure that there is adequate space at the kerbside for the delivery of the Goods to take place. You will be responsible for arranging the movement of the Goods from the kerb to the ultimate destination at your risk and you may need assistance where the Goods are large or heavy. The delivery driver will not be able to assist you with this and we will not provide any unpacking, installation, fitting or waste removal services.
  6. You are responsible for and will legally own the Goods once they have been delivered kerbside to the address specified by you when you placed your Order with us, regardless of whether you are available in person at the address on delivery.
  7. If we are unable to deliver the Goods as a result of your action or inaction, we will need to arrange an alternative Delivery Date.
  8. We do not make deliveries to any locations outside of mainland Great Britain. For example, we will not deliver to any islands that are not part of mainland Great Britain. See our Delivery Policy for more information.
  9. Unless you and Catnic agree otherwise, if we cannot deliver your Goods within 30 days of the date of your Order Confirmation, we will:
    • inform you;
    • cancel your Order; and
    • issue you with a refund.

Payment and pricing

  1. The agreed price for the Goods is set out in your Order. All prices are in pounds sterling (£)(GBP) and include VAT at the applicable rate, but exclude delivery charges which will be calculated according to your chosen delivery option, location and the Goods. For information on delivery options and costs, please see our Delivery Policy.
  2. Payment should be made using your debit or credit card that is accepted by Catnic’s third-party payment service provider (“Payment Processor”). Please follow the instructions provided by Catnic’s Payment Processor in order to make your payment. In addition to these Conditions, any payments made using the Payment Processor’s services will be subject to the terms of use and privacy policy of the Payment Processor which are available here. Please read these terms of use and privacy policy carefully before making your payment.
  3. Unless there is any negligence on Catnic’s part, any failure by Catnic to comply with these Conditions or Catnic’s Privacy Policy or a breach by Catnic of its duties under applicable laws, Catnic will not be legally responsible to you for any loss that you may suffer as a result of any act or failure to act by the Payment Processor or if a third party gains unauthorised access to any information that you give Catnic or the Payment Processor in connection with your payment.
  4. Your debit or credit card will only be charged once the Goods have been picked and are due to be dispatched.

Right to cancel

  1. You have the right to cancel the Contract within 14 days without giving any reason.
  2. The cancellation period will expire after 14 days from the day on which the Goods are delivered to you.
  3. To exercise the right to cancel, you must inform us of your decision to cancel this Contract by a clear statement using the contact details set out in Condition 26
  4. You can also electronically fill in and submit the Online Order Support form or any other clear statement on our website. If you use this option, we will communicate to you an acknowledgement of receipt of such a cancellation on a durable medium (for example, by email) without delay.
  5. To meet the cancellation deadline, you must send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

  1. If you cancel this Contract, we will reimburse you for the payment of the value of the Order (or value of part of the Order cancelled) which we have received from you. Where you cancel the entire Order, we will also reimburse the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard offered by us).Where you cancel part of the Order, we may recalculate the applicable delivery charge and deduct this from your refund.
  2. We may make a deduction from any refund for loss in value of any Goods supplied, if the loss is the result of unnecessary handling by you, which means the Goods can no longer be sold at full value. This includes handling the Goods beyond what is necessary to establish the nature, characteristics and functioning of the Goods, in particular, if it goes beyond the sort of handling that might reasonably be allowed in a shop. In some cases, because of the way you have handled the Goods, no refund may be due.
  3. We will make the refund without undue delay, and not later than:
    • (a) 14 days after the day we have collected the Goods supplied back from you; or
    • (b) if there were no Goods supplied, 14 days after the day on which we are informed about your decision to cancel this Contract.

Specification and standards

  1. Subject to the provisions of these Conditions, Goods supplied by Catnic will, at the date of delivery, comply with any specification and standard specified by Catnic on its website. You should satisfy yourself that the Goods are suitable for any purpose for which you intend to use them.

Weight, Quantity and Packaging

  1. Whilst Catnic try to make sure that:
    • (a) the weight or quantity of the Goods specified on our website or set out in the Order are as accurate as possible, there may be a small tolerance of up to 10% in such weights, sizes and measurements of the Goods; and
    • (b) the colours of the Goods are displayed accurately on our website, the actual colours that you see on your device may vary depending on the device that you use.

Limitations on Liability

  1. Except for any legal responsibility that Catnic cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, Catnic is not legally responsible for any:
    • (a) losses that are not foreseeable to you and Catnic when your Contract was formed;
    • (b) losses that were not caused by any breach by Catnic of these Conditions;
    • (c) business losses; or
    • (d) losses to non-consumers.

Claims

  1. The Consumer Rights Act 2015 gives you certain legal rights (also known as ‘statutory rights’). If the Goods are not as described, or there is a fault that was present at the time the Goods were delivered to you which means the Goods are not of satisfactory quality or fit for purpose, then you may have certain statutory rights. For detailed information on your statutory rights as a consumer from Citizens Advice please visit your local Citizens Advice centre or www.citizensadvice.org.uk.
  2. You should contact Catnic as soon as possible if you become aware of a problem with the Goods so that we can offer a repair, replacement or refund as appropriate in accordance with your statutory rights.

Cancellation by Catnic

  1. Catnic may be unable to accept your Order or may cancel your Contract at any time by providing you with written notice where:
    • Catnic ceases to make or supply the Goods;
    • Catnic is no longer able to supply the Goods in accordance with your Order;
    • Catnic has reasonable ground to believe that you will be unable to meet your financial obligations in respect of your Contract.

Third Party Rights

  1. No one other than you or Catnic has any right to enforce any term of this Contract.

Circumstances beyond Catnic’s reasonable control

  1. Catnic is not liable to you if it fails to comply with this Contract because of circumstances beyond its reasonable control.

Assignment

  1. Your Contract is not transferable or assignable to another person or party.

Disputes and Governing Law

  1. We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with the Goods which you ordered, then please contact us as soon as possible using contact details set out in Condition 26.
  2. Where you have contacted Catnic but we have been unable to resolve your compliant or you are unhappy with the outcome, you may want to use alternative dispute resolution (ADR). ADR is a process for resolving disputes between you and Catnic that does not involve going to court.
  3. In addition, you can still bring court proceedings. The laws of England shall apply to the Contract.
  4. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England. This means that you can choose whether to bring a claim in the courts of England or in the courts of another part of the UK in which you live.
  5. This Contract is only available in English. No other languages will apply to this Contract.

  1. Catnic’s Privacy Policy is available here. Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.
